A 5 page discussion of the application of the Fourteenth Amendments provisions for free speech to symbolic actions. Examines Spencer v. Washington, Stromberg v. California, Terminiello v. Chicago, Texas v. Johnson, and Tinker V. Des Moines Independent Community School District to determine the applicability of free speech to symbolic actions such as the wearing of certain clothing as a form of protest. Concludes the applicability of the free speech provisions to symbolic acts is dependent on the manner in which the act is performed as well as whether the act is sufficiently imbued with the element of communication.
