Accountability and quality have long been the watchwords of commerce; no matter the product or service, consumers were secure in the notion that what they purchased was going to be in working condition as indicated by package claims or advertisement; if the item or repair was faulty, customer service would happily replace the product or rectify the problem. Today, however, the aspect of implied warranty whereby consumers are led to believe a product will operate as represented has become as worthless as two-dollar bill: No matter what implied claims are made with regard to product performance and/or effectiveness, the company can relieve itself of all liability with the caveat that items are sold on an 'as-is' basis. This new-fangled breach in business accountability presents a particularly significant problem in the arena of Information Technology, especially when - for example - the developer had previous knowledge of faulty software yet put it on the market anyway knowing he was not legally responsible for residual effects caused by the product.
